Terms and Conditions for CoffeeCo doo Beograd “Pogon Fidelity Card Program” Nothing herein contained is intended to affect, nor will it affect, a Consumer’s statutory rights under Serbian Consumer Protection Act 2014 (Zakon o zaštiti potrošača ) or any amendments thereof or statutory additions thereto.

CoffeeCo doo Beograd, owner of Pogon Brand and operator of Pogon Coffee bar outlets, is instating a “Pogon Fidelity Card program” with a view to offering more value to its customers (Fidelity Plans) link to Fidelity Plans. The following terms and conditions apply to all Fidelity Plans and usage of the Pogon Fidelity Card will be considered as constituting acceptance of these
terms and conditions by the scheme member.

1. The Fidelity Plans are operated and promoted by CoffeeCo doo Beograd, Ilije Garasanina 49, 11000 Belgrade Serbia.

2. These terms and conditions, in conjunction with customer privacy link to privacy policy ,are applicable across the “Pogon Fidelity Card” Fidelity Plans and any participation as constituting acceptance of these terms and conditions by the Fidelity plans members. Additional terms and conditions may apply for optional elements of the Fidelity Plans, examples of which include but are not limited to, Christmas savers, club membership, and gift cards. Members participating in the optional elements of any of the Fidelity plans will be considered as having accepted any applicable additional terms and conditions.

3. The Pogon Fidelity Card issued by CoffeeCo doo Beograd remains the property of CoffeeCo doo Beograd.

4. CoffeeCo doo Beograd may at any time terminate any of its Fidelity Plan(s) or alter or amend the terms & conditions of operation of those Fidelity Plans. CoffeeCo doo Beograd retains the right to alter products and outlets included or excluded from any of the Fidelity Plans. CoffeeCo doo Beograd will inform fidelity card holders of such changes through a mailing to their email address as registered in the data base of the Pogon Fidelity Card Program.

5. All members of any of the Fidelity Plans must be resident within the Republic of Serbia and be over the age of 16.

6. Members are only entitled to one loyalty card account each. CoffeeCo doo Beograd reserves the right to refuse, merge or close additional accounts at any time.

7. The Pogon Fidelity Card cannot be used as a credit /debit or guarantee card.

8. Members must register their personal details by filling and submitting in any Pogon outlet the Pogon Fidelity Card Flyer and keep CoffeeCo doo Beograd informed of any changes to these details. CoffeeCo doo Beograd cannot be held responsible for any loss of benefits from the Pogon Fidelity Card as a result of out of date member details.

9. The Pogon Fidelity Card, in which ever form is nontransferable to any other member,
cannot be copied and can only be used by the member who is named and registered for the card.

10. The security of the card remains the responsibility of the Fidelity plan member, as do any security details relating to the account. CoffeeCo doo Beograd cannot be held responsible for any loss or damage arising from the member failing to ensure the safe-keeping of these items.

11. CoffeeCo doo Beograd may decline to issue, withdraw or cancel a Fidelity card accounts and points, in whatever form, and/ or remove a member from any of the Fidelity Plans at any time where CoffeeCo doo Beograd have a reasonable belief that there may be;

1. Any abuse or attempted abuse of the Fidelity plan(s)
2. Any breach or attempted breach of these terms and conditions and/or those
relating to the optional elements of the Fidelity Plan(s).
3. Any behavior relating to the Pogon Fidelity Card or to CoffeeCo doo Beograd
that involves theft, misconduct, abusive or offensive behavior, or supplying false or misleading information.

12. Pogon Fidelity Cards may only be used for purchases from any Pogon outlet and to benefit from promotions made by third party partners who are or may become part of the Fidelity Plan(s).

13. The Fidelity Plan(s) are only for consumer use. The Pogon Fidelity Card cannot be used for any transaction where the beneficiary is a business entity.

14. The Pogon Fidelity Cards cannot be bought, sold or in any way traded.

15. Two members who reside at the same address may have individual accounts.

16. Members can choose to leave the plan(s) at any time, by leaving the plan(s) members forfeit the right to any benefits from any of the Fidelity Plans.

17. Members who do not use their card in a a Pogon outlet for 4 months will be removed from the scheme and will need to re-apply for new membership should they wish to rejoin, however if personal details are properly maintained by the member in accordance with section 8 hereof CoffeeCo doo Beograd may at its sole discretion resurrect the loyalty card.

18. In addition, CoffeeCo doo Beograd reserve the right to;

1. Stop issuing cards at any time
2. On notice, to amend the benefits of any of its Plans at any time
3. On notice, to alter or amend the terms and conditions of operation of the Pogon Fidelity Card and / or Plan(s)
4. On notice, withdraw or cancel cards and / or benefits and / or terminate any of the Plans.

19. CoffeeCo doo Beograd will notify card holders of any changes to these terms and conditions. Notices detailing the revised terms and conditions will be available on www.pogoncoffee.com.

20. Nothing herein contained is intended to affect, nor will it affect the Serbian Consumer
Protection Act 2014 or any amendments thereof or statutory additions thereto.

21. These terms and conditions and the Fidelity Plans are subject to the laws of the Republic
of Serbia.
